Appropriateness decision

What does Appropriateness decision?

The European Commission has the possibility to request a non-EU or non-EEA country (so-called -> Third country) or an international organization as to whether a level of data protection comparable to the European legal situation exists there (Art. 45 GDPR). The national legislation of the country, its supervisory authorities and the international obligations it has entered into are taken into account.

Practical example

With the Transmission of personal data to Canada, one company invokes the Appropriateness decision of the EU Commission, which confirms an adequate level of data protection.
