Frequently asked questions about the Whistleblower Directive

The protection of whistleblowers is inconsistent and fragmented at national and European level. As a result, whistleblowers are often reluctant to come forward for fear of retaliation.

Against this backdrop, on April 23, 2018, the European Commission presented a package of whistleblower initiatives, including a proposal for a Whistleblower Directive to protect whistleblowers who report breaches of Union law and to establish defined reporting channels for whistleblowing. The Directive creates a comprehensive legal framework for the protection of whistleblowers to protect the public interest at EU level, establish easy-to-use reporting channels, emphasize confidentiality and prohibit retaliation against whistleblowers, and establish targeted protection measures.

On October 23, 2019, the European Parliament and the Council adopted Directive (EU) 2019/1937 on the protection of persons who report breaches of Union law, which entered into force on December 16, 2019. The EU member states had until December 17, 2021 to transpose the Whistleblower Directive into their national law.

Whistleblower protection in the European Union has been a patchwork that has discouraged individuals from raising concerns (particularly in global roles where it is unclear which law/jurisdiction applies). Increased whistleblower protection is an economic win. Public procurement in the EU is estimated to have lost between €5.8 and €9.6 billion due to a lack of whistleblower protection. This was in a "normal" year, without a global pandemic and dramatic increases in public spending.
The notifications are limited to breaches of certain EU laws, including those relating to financial services, food and product standards, public health and public procurement, and consumer protection. There are some Member States (e.g. Denmark) that go further and extend this to serious misconduct and breaches of national law, but other Member States (e.g. Germany) are criticized for their plans to apply only the minimum approach.
It covers more than just employees and workers. The scope extends to freelancers, employees, unpaid volunteers, non-executive directors, shareholders, suppliers and contractors.
The establishment of communication channels (internal and/or external) to receive written or verbal reports would be an advantage. Currently, this requirement only applies to organizations with 50 or more employees in the private sector. However, Member States may extend this requirement to organizations with fewer than 50 employees.
An impartial and professionally trained person or team should be professionally trained and responsible for handling all reports submitted to them.
Reports should be confirmed within 7 days and feedback and follow-up should be provided within 3 months (in complex cases this can be extended to 6 months, for example).
Whistleblowers should be protected from retaliation (e.g., removal from assignments, negative performance reviews, blacklisting, psychiatric/medical referrals).
