Safe Harbor

What does Safe Harbor?

As a predecessor instrument to the Privacy Shield the safe harbor regulation was also considered Appropriateness decision for the Transmission of personal data to the USA. In its ruling of 6.10.2015 (case no. C-362/14), the ECJ Safe Harbor declared invalid.

Practical example

Until 2015, companies were able to use the Safe Harbor Agreement to transfer data to the USA; after it was invalidated, they had to switch to other guarantees.
