Public body

What does Public body?

Public bodies are the authorities, the organs of the administration of justice and other institutions organized under public law of the federal government, the federally independent corporations, the institutions and foundations under public law as well as their associations regardless of their legal form (Section 2 (1) BDSG). Public bodies of the federal states are the authorities, the organs of the administration of justice and other institutions organized under public law of a federal state, a municipality, an association of municipalities or other legal entities under public law subject to the supervision of the federal state, as well as their associations, irrespective of their legal form (Section 2 (2) BDSG). Associations under private law of public bodies of the federal government and the federal states that perform public administration tasks are deemed to be public bodies of the federal government, irrespective of the participation of non-public bodies, if they operate beyond the area of a federal state or if the federal government holds the absolute majority of shares or is entitled to the absolute majority of votes. Otherwise, they are considered public bodies of the federal states (Section 2 (3) BDSG). If a non public body public administration, it is to that extent responsible for the public administration. public body within the meaning of this Act (Section 2 (4) sentence 2 BDSG).
