Les clients auraient notamment \u00e9t\u00e9 attir\u00e9s par les services \"Payroll Rewards\" et \"Premium Wire\" en leur faisant miroiter de possibles \u00e9conomies d'imp\u00f4ts qui n'\u00e9taient pas r\u00e9elles.<\/p><p>En outre, les commerciaux d'Amex auraient permis \u00e0 des clients professionnels d'acheter des cartes de cr\u00e9dit sans pr\u00e9senter les num\u00e9ros d'identification de l'employeur (EIN). Les NIE sont exig\u00e9s par la loi aux \u00c9tats-Unis lorsque le b\u00e9n\u00e9ficiaire de la carte est une personne morale. Des employ\u00e9s d'American Express auraient utilis\u00e9 des NIE fictifs tels que \"123456788\" lors de l'ouverture de comptes de cartes de cr\u00e9dit pour des petites entreprises en 2015 et au premier semestre 2016.<\/p><p>Amex a d\u00e9j\u00e0 r\u00e9agi \u00e0 l'enqu\u00eate du DOJ et du procureur du district est de New York. La soci\u00e9t\u00e9 de cartes de cr\u00e9dit a mis fin \u00e0 l'offre et aux pratiques de vente de Premium Wire en 2021. Cette d\u00e9cision vise \u00e0 r\u00e9gler les all\u00e9gations de pratiques de marketing trompeuses qui enfreignent le Financial Institutions Reform, Recovery and Enforcement Act (FIRREA).<\/p><p>AMEX a conclu un accord de non-proc\u00e8s (Non-Prosecution Agreement, NPA) avec le bureau du procureur g\u00e9n\u00e9ral des \u00c9tats-Unis pour le district est de New York, \u00e9galement pour participation \u00e0 des pratiques de vente et de marketing trompeuses. Outre le paiement d'une nouvelle amende, la soci\u00e9t\u00e9 de cartes de cr\u00e9dit a \u00e9galement accept\u00e9 de coop\u00e9rer avec le minist\u00e8re public am\u00e9ricain pour les trois prochaines ann\u00e9es. En contrepartie, le minist\u00e8re public renonce \u00e0 une inculpation. Au total, 138 millions de dollars am\u00e9ricains seront vers\u00e9s aux deux autorit\u00e9s.<\/p><p>Une autre amende est inflig\u00e9e \u00e0 la Fed en tant qu'autorit\u00e9 de surveillance, apr\u00e8s qu'un accord de principe a \u00e9galement \u00e9t\u00e9 trouv\u00e9 \u00e0 ce sujet.
