Elle conclut que les \u00c9tats-Unis garantissent un niveau de protection ad\u00e9quat pour les donn\u00e9es \u00e0 caract\u00e8re personnel transf\u00e9r\u00e9es conform\u00e9ment au cadre de protection des donn\u00e9es UE-\u00c9tats-Unis. Le cadre de protection des donn\u00e9es UE-\u00c9tats-Unis est un syst\u00e8me de certification par lequel les organisations am\u00e9ricaines s'engagent \u00e0 respecter une s\u00e9rie de principes de protection des donn\u00e9es publi\u00e9s par le minist\u00e8re am\u00e9ricain du commerce. Ces principes s'appliquent imm\u00e9diatement apr\u00e8s la certification. Ils n'affectent pas les exigences du r\u00e8glement (UE) 2016\/679 qui s'appliquent aux entit\u00e9s de l'Union qui transf\u00e8rent des donn\u00e9es, telles que la limitation des finalit\u00e9s, la minimisation des donn\u00e9es, la transparence et la s\u00e9curit\u00e9 des donn\u00e9es.<\/span><\/span><\/p>\n<p><span class=\"break-words\"><span dir=\"ltr\">Les donn\u00e9es \u00e0 caract\u00e8re personnel peuvent \u00eatre transf\u00e9r\u00e9es de l'UE vers les \u00c9tats-Unis dans le cadre du RGPD UE-USA, \u00e0 l'exception des donn\u00e9es collect\u00e9es pour la publication, la diffusion ou d'autres formes de communication publique de mat\u00e9riel journalistique. Le cadre UE-\u00c9tats-Unis pour le traitement des donn\u00e9es s'applique aux organisations situ\u00e9es aux \u00c9tats-Unis qui sont consid\u00e9r\u00e9es comme des responsables du traitement ou des sous-traitants et qui sont tenues par contrat de n'agir que sur instruction du responsable du traitement de l'UE et d'aider ce dernier \u00e0 r\u00e9pondre aux demandes des personnes qui exercent leurs droits conform\u00e9ment aux principes. Selon le cadre de protection des donn\u00e9es UE-\u00c9tats-Unis, les donn\u00e9es \u00e0 caract\u00e8re personnel doivent \u00eatre trait\u00e9es de mani\u00e8re licite et loyale et ne doivent pas \u00eatre incompatibles avec les finalit\u00e9s pour lesquelles elles ont \u00e9t\u00e9 initialement collect\u00e9es.<br \/><\/span><\/span><\/p>\n<p><span class=\"break-words\"><span dir=\"ltr\">Dans certaines circonstances, il n'est pas n\u00e9cessaire de demander le consentement pour le traitement de donn\u00e9es sensibles. Toutefois, conform\u00e9ment au principe d'int\u00e9grit\u00e9 des donn\u00e9es et de limitation des finalit\u00e9s, les organisations doivent veiller \u00e0 ce que les donn\u00e9es \u00e0 caract\u00e8re personnel soient exactes, compl\u00e8tes et \u00e0 jour, et ne doivent conserver les donn\u00e9es \u00e0 caract\u00e8re personnel que pendant la dur\u00e9e n\u00e9cessaire \u00e0 la r\u00e9alisation de la ou des finalit\u00e9s pour lesquelles elles ont \u00e9t\u00e9 initialement collect\u00e9es ou pour lesquelles la personne concern\u00e9e a donn\u00e9 son consentement, conform\u00e9ment au principe de libre choix. En outre, les donn\u00e9es \u00e0 caract\u00e8re personnel doivent \u00eatre trait\u00e9es de mani\u00e8re \u00e0 garantir leur s\u00e9curit\u00e9, y compris la protection contre le traitement non autoris\u00e9 ou illicite et contre la perte, la destruction ou les dommages accidentels.
